At VideoGifts, we value your privacy and are committed to protecting your personal information. This Privacy Policy explains how we collect, use, and store your data when you use our website or contact us through our forms.
1. Identity of supplier
The VIDEOGIFTS service is supplied by Jems Vandendriessche, Regina-Jonas-Strasse 37, 10999 Berlin, Germany, registered in Germany under Steuernummer 14/569/72569, jens@videogifts.com.
2. Main characteristics of the VIDEOGIFTS service
The VIDEOGIFTS service allows you to upload one or more videos and have them video edited into a VIDEOGIFTS montage for personal use according to the modalities you choose: style, duration, and music.
The uploaded videos are first checked for quality. If the quality is too low, we will not be able to video edit your footage.
If the quality and contents of your videos are acceptable, we will send you an e-mail with:(i) the final price to be paid, depending on the length of the videos and the choices you have made, including the length of the montage, style, and music; and (ii) the delivery period.
You will then have [1 month] to confirm the purchase and pay the price. If no confirmation or payment is received within that [1 month], your request will be cancelled and the uploaded videos will be permanently deleted.
Once you have paid the final price, your order is placed and there is a contract.
When you choose music that is copyright protected, such as famous songs, the price includes the license for the music. In that case, the VIDEOGIFTS montage will be delivered to you through a YouTube channel: either your YouTube channel or a YouTube channel that we create for you and hand over to you. Further distribution of the VIDEOGIFTS montage is then limited to the YouTube channel only.
When you choose music that is not copyright protected, such as non-mainstream songs, the VIDEOGIFTS montage will be delivered to you as an MP4 file that we send to you by e-mail.
The VIDEOGIFTS montage that we deliver to you is a final work product and cannot be changed anymore, except subject to an additional fee.
3. Pricing
Pricing for your VIDEOGIFTS montage depends upon the total length of the videos you upload, the length and style of the montage you want, and the music you have chosen.
You can find standard pricing on the website but the final price is confirmed to you by e-mail once we have received your videos. Prices include all applicable taxes, costs and licenses.
4. No right of withdrawal
Once you have paid the price that we confirm to you by e-mail, you cannot withdraw from your purchase of the VIDEOGIFTS service because the VIDEOGIFTS montage is personalized and can by its nature not be returned. This is a legal exception to the right of withdrawal.
5. Restrictions on distribution of your VIDEOGIFTS montage
If you opt for a delivery through a YouTube channel, the further distribution of your VIDEOGIFTS montage is limited to that YouTube channel only. This is due to the license for the use of the music that you have chosen: this license is only valid for use on YouTube.
If you opt for a delivery of your VIDEOGIFTS montage through e-mail, you are free to distribute the VIDEOGIFTS montage by any means online and offline as you wish.
In any case, the use of the VIDEOGIFTS montage is always limited to personal use only and it cannot be used for other purposes. Consequently, any commercial, political and other use than personal is prohibited.
If you exceed any of the above restrictions, you are responsible for and will have to pay any applicable additional fees. You will also indemnify VIDEOGIFTS against and hold it harmless for any claim by any third party in relation to the non-respect of any of the above restrictions.
6. Prohibited content
We will not provide the VIDEOGIFTS service if your videos contain one or more of the following:
- Sexual acts
- Pornography
- Sexually oriented nudity
- Images that are clearly taken without the persons’ awareness, e.g. hidden camera footage
- Violence
- Hatred
- Hate speech
- Offensive content
- Acts that are illegal
- Dangerous acts
- Political messages
- Fake news
- Terrorist content
- Advertising and marketing
- Any content against the general standard of good behaviour and public morality
7. Data protection
We process your personal data in accordance with our privacy policy, which you can find here.
If our offer for a VIDEOGIFTS montage is not confirmed or paid within 1 month after the date of the offer, the videos you uploaded will be permanently deleted.
8. Applicable law and jurisdiction
Without prejudice to the mandatory rights you may have as a consumer under the laws applicable in your jurisdiction, the VIDEOGIFTS service and this contract are exclusively governed by Belgian law.
Without prejudice to your mandatory right to initiate court proceedings before the courts of your residence, only the commercial court of Belgium, Antwerpen, district Antwerpen, shall have exclusive jurisdiction in case of disputes.
